When it comes to hanging branches and needing to address them, there are always questions about “who is responsible?”
I am going to touch on two of the most asked questions here in the tree world.
Let’s say your neighbor has a large tree that overhangs into your yard. This makes it difficult to mow under or is blocking sunlight from a garden. In the state of Texas you do have a right to cut this tree. (Though when approaching this I recommend speaking to your neighbors to keep communication open.) If you decide to proceed, it is your right to cut back to your property line only. This rule also applies to the roots of the tree. If pruning continues, it is also your responsibility to maintain the health of the tree. So, make sure to educate yourself on proper pruning techniques, or call your local professional.
Another common question asked is when cutting around wires, whether it is power lines or telephone wires, rules apply to both. If the line in question sits on your and the city’s property line, you may be able to get the wire company to address it. However, if it is your yard it is your responsibility. In Texas, limbs that are within 6ft of any wires you must hire a professional. Only professionals with authorization from the wire companies can then do that work.
